When you order Goods from this Website you agree to be bound by these Terms and Conditions.

This website is operated by Alpha PC. Throughout the site, the terms “we”, “us” and “our” refer to Alpha PC. Alpha PC offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time.

Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms. Ability to transfer or subcontract: We may subcontract any part or parts of delivery of the Goods or the Services that we provide to you from time to time and we may transfer our rights and/or obligations under this Agreement without your consent or any requirement to notify you. Changes to the Terms and Conditions: We may alter or vary the Terms and Conditions at any time. Any variations or updates to these Terms and Conditions will be published on our Website. You will be deemed to accept the latest version of the Terms and Conditions when you buy our Goods or Services. Entire Agreement: This Agreement constitutes the entire agreement between you and us. No other terms whether expressed or implied shall form part of this Agreement. In the event of any conflict between these Terms and Conditions and any other term or provision, these Terms and Conditions shall prevail. By accepting this Agreement, you are also unambiguously agreeing to the Returns Policy and the Privacy Policy. You should not use our Website or the Services if you do not accept these Terms and Conditions, the Returns Policy and the Privacy Policy. Invalidity: If any term or condition of our Agreement shall be deemed invalid, illegal or unenforceable, we agree that such term or condition shall be deemed to be deleted and the remainder of the Agreement shall continue in force without such term or condition. Jurisdiction and English Law: These Terms and Conditions and our Agreement shall be governed by and construed in accordance with the laws of England and Wales. The parties hereto submit to the exclusive jurisdiction of the courts of England and Wales. Delays: No delay or failure on our part to enforce our rights or remedies under the Agreement shall constitute a waiver on our part of such rights or remedies unless such waiver is confirmed in writing. Rights of Third Parties: It is not intended that the undertakings and obligations of the parties set out in this document shall be for the benefit of and capable of being enforced by any other person by virtue of the Contracts (Rights of Third Parties) Act 1999.

Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. Our computers may contain used components and we may not necessarily install brand new components on every custom computer we build. All the products, items, and components are sold as is, final sale. We do offer repair services for our custom-built computers. SECTION 8 - ACCURACY OF BILLING AND ACCOUNT INFORMATION 

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. 

 

SECTION 9 - OPTIONAL TOOLS 

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). We hope that you will not have any complaints about our Services however if you do have an issue please contact us and we will do our best to respond within 5 business days. If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

You agree to indemnify, defend and hold harmless Alpha PC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party. 

 

SECTION 17 - SEVERABILITY 

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 22 - ORDERING FROM US

When you order Goods and/or Services from us you are entering into a contract with us for the purchase of the Goods and/or the performance of the Services. You must take particular care when providing us with your details to ensure that these are accurate and complete at the time of ordering. Any order that you place with us is subject to product availability and acceptance by us. When you place your order online, we will send you an email confirming your order (the Order Confirmation). If the Goods are not available, we will contact you by telephone or email and offer you an alternative Product or the option of cancelling your order. Goods and Services purchased from this Website are intended for your use only and you warrant that any Goods purchased by you are not for resale, unless you are registered as a re-seller with us. When ordering from this Website you may be required to provide a username and password. You must ensure that you keep these details secure and do not provide this information to a third party. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Website. The description and price of goods you order will be as shown on our website at the time you place your order. After placing an order, you will receive an e-mail from us acknowledging that we have received your order (the Order Confirmation). The contract between us (Contract) will only be formed when we send you the Order Confirmation.

 

SECTION 23 - PRICES

All Prices shown on the website are inclusive of value added tax (where applicable) but exclusive of delivery charges. Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an Order Confirmation. The total price for Goods or Services ordered, including delivery charges, will be displayed on the Website when you place your order. When you are paying by credit or debit card payment will be taken at the time of placing your order and not when the order is dispatched. Where payment is made by cheque or bank transfer, we shall not dispatch any Products until we receive cleared funds. No payment shall be deemed to have been received until we have received cleared funds. Where an order is made using finance to pay for goods, delivery must take place to the address given on the finance application. Our Website contains many Products and it is always possible that, despite our best efforts, some of the Products listed on our Website may be incorrectly priced. We are under no obligation to provide the Product to you at the incorrect price, even after we have sent you an Order Confirmation, if an error in our pricing is found. The price will be verified once your order is assembled. If an error in our pricing is found, we will inform you as soon as possible by telephone or email and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, we will refund or re-credit you for any sum that has been paid by you or debited from your credit/debit card for the goods In some cases it may be necessary for us to request further information from you in order to perform CNP (cardholder not present) checks on payments received for the purpose of avoiding fraud. This is in the interest of all card holders. If you are unable to provide further information upon request the order may be cancelled or the delivery address amended to the registered card address at our discretion.

 

SECTION 24 - PROMOTIONS

Promotions, such as game codes, vouchers, free items and rebates are subject to availability. Promotions can be terminated at any time and without notice. We will endeavor to honor all promotions, but we cannot be held liable where promotions expire, are discontinued, terminated or unavailable. In rare circumstances promotions may expire after the point of ordering and before the order is dispatched to you. We cannot be held responsible in these circumstances. Promotions have a cash value of $0.01.

 

SECTION 25 – SHIPPING POLICY

Shipment confirmation and order tracking
Once the order is processed, you will receive an invoice and a tracking number.

Customs, duties, and taxes
Alpha PC is not responsible for any customs and taxes applied to your order. All fees imposed during or after shipping are the responsibility of the customer (tariffs, taxes, etc.).

Damages
Alpha PC is not liable for any products damaged or lost during shipping. If you received your order damaged, please contact the shipment carrier or our support team directly to file a claim. Please save all packaging material and damaged goods before filing a claim.

International Shipping Policy
At this time we only ship to the US and Canada. Your credit card company will bill you with your local currency at the current exchange rate. All orders to Canada and the US are shipped via Canada Post. Orders to the US will arrive 5 to 7 days after the order is placed. When ordering outside of Canada, the recipient is responsible for assuring the product can be legally imported to the destination country. The recipient is the importer of record and must comply with all laws and regulations of the destination country. The recipient of an international shipment may be subject to import taxes, customs duties and fees, which are imposed once a shipment reaches the recipient's country. Additional charges for customs clearance must be fulfilled by the recipient. Alpha PC has no control over these charges, nor can Alpha PC predict what they may be. Customs, duties, and taxes are non-refundable: so, a shipment that is refused because of unexpected import fees, the cost of the original shipping and any return shipping charges will not be refunded. Customs policies vary widely from country to country; you should contact your local customs office for more information. When customs clearance procedures are required, it can cause delays beyond our original delivery estimates. To avoid a delay in receiving your order from customs, we strongly suggest:

  • Providing a phone number where you can be reached by customs when your product arrives. This phone number will be listed on the commercial invoice so customs can reach you to clear your order.
  • Please do not refuse a shipment or ignore requests from carriers regarding duty and/or tax liability charges. Be aware that most carriers will hold a shipment for 5 days after arrival in your country before they return it to the sender.

We do not refund original shipping charges for goods that are refused for delivery at customs.

 

SECTION 26 - DELIVERY

Delivery periods quoted at the time of ordering are approximate only and may vary. Goods will be delivered to the address nominated by you at the time of ordering. Your order will be fulfilled as soon as possible after your Order Confirmation and in any event within 30 days of the date of the Order Confirmation, unless there are exceptional circumstances. Please ensure that you or someone who is authorized to sign for the goods on your behalf is available to take receipt of the goods. When accepting delivery please inspect the package for any visible signs of damage. If there is damage, then you can either refuse the delivery or sign for the package as damaged. The Products will be at your risk from the time of delivery. You may collect the Goods from our premises by arranging this with us in advance. Please ensure that you have valid identification at the time of collection to demonstrate proof of your name and order address. If you order Products from our Website for delivery outside of Canada, they may be subject to export/import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order. Please note that Goods may be subject to inspection by your local customs office where delivery is outside of Canada.

 

SECTION 27 – CUSTOM ORDERS

We take custom orders where we obtain information of the following, not limited to, the customers budget, parts inclusion, completion date, and any other requests. Once we obtain the information, we will quote the customer of the cost to complete the build. We may take up to a month to complete and ship the custom computer. We require all custom builds to pay %100 of the quoted price ahead of time before we start the order. In some requests, we may approve a different percentage of upfront payment before we start the build. If this so, once we complete the build, we require the customer to pay the rest of the payment before shipping the product out. Warranty policies and repair policies apply to this service as well. We may use different parts than the original agreement if the parts are out of stock and / or the prices of the components have changed since the original request. We do our best to notify the client of any changes that may occur during the custom build process. If the client decides to cancel the custom request, we are obligated to charge up to %10 of the original quote to cover costs of the parts we have invested in. SECTION 28 - WARRANTY POLICY

All our systems include 14-day warranty as standard.  If the fault is developed with in the first 14 days of purchase we will collect, fix and return your system at only shipping cost to you. Simply contact us and box up the computer in its original packaging and ship it to the address we provide you. We will then repair your computer and return it to you. You will only need to cover shipment charges and any duty fees if applied.

WARRANTY EXCLUSIONS
1. Accidental Damage.
2. General wear and tear, misuse, neglect or damage by the buyer.
3. Incorrectly installed components / not original components.
4. Overheating due to excessive dirt/dust build-up.
5. Data Recovery & Backing up of data, files and programmes.
6. The remedy of incorrectly installed/incompatible software which is not provided
7. The remedy of viruses.
8. Compatibility of 3rd party software/hardware.

Extended Warranty

Alpha PC offers repairs ONLY on Alpha PC’s computers. All our systems include 14-day warranty as standard. The charge per repair will be as follows:

Damages and issues 
Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.

Exceptions / non-returnable items 
Certain types of items cannot be returned, like perishable goods (such as food, flowers, or plants), custom products (such as special orders or personalized items), and personal care goods (such as beauty products). We also do not accept returns for hazardous materials, flammable liquids, or gases. Please get in touch if you have questions or concerns about your specific item. Unfortunately, we cannot accept returns on sale items or gift cards.

 

SECTION 30 - CANCELLATION, RETURNS, AND REFUNDS

Alpha PC does not offer the option to return or refunds on any computers, components, or peripherals after they have been shipped out. We do however have a warranty policy in place, please see the “Warranty Policy” section. All purchases made are final sale. Alpha PC is not responsible for any damage caused by shipping. Alpha PC is not responsible for any stolen goods. The recipient will need to contact local enforcement to report any stolen products. For repair services, please refer to the repair policy. You may contact us for additional information if you have any disputes by either starting a chat on the main page or by email at main@alphapc.ca. If you are contracting as a consumer, you may cancel a pending order not yet shipped. If the item is shipped, we do not accept any cancellations and / or returns. You must notify us via durable medium (Phone / email) and quote your order number in any communication. If you are cancelling a custom build order, we may charge up to %10 of the original quote given to the consumer to fulfill the custom build. If you are contracting as a Business / Trade customer, this clause does not apply. Any orders by or on behalf of a business cannot be cancelled once they have been placed. An order will be deemed to be a Business Order, if it is paid via business bank account or business debit / credit card, or a company address, or purchase order number has been provided. Once a cancelled is requested on non-shipped products, we will refund your debit or credit card or issue a cheque or bank transfer for the full amount paid within 14 less the collection charge we paid for the collection of the Goods if applicable. If the goods supplied to you are incomplete/incorrect or physically damaged then you should notify us via email, phone, or web message within 24 hours of delivery. Failure to notify us with 24 hours of receipt will result in the determination that any physical damage occurred whilst in your care and that the goods were supplied correctly and in full. If you suspect that the Goods are faulty and wish to warranty / fix the item, please see warranty section. We will examine the returned Product and if you are entitled, we will notify you of your options via e-mail within a reasonable period of time. We will process a repair, replacement as soon as possible. All items must be shipped to us using your own delivery method. The consumer has a duty of care to ensure the Products are packaged sufficiently, for the type and value of goods being returned. Due to the nature of the goods supplied, we recommend original packaging is used. Where you use your own packaging, liability for the cost of repairing damage resulting from inadequate packaging rests with you. We will only confirm that the item has arrived back to us in a satisfactory condition once we have opened and inspected the item. We do not offer any exchanges on any components or computers. SECTION 31 - UPGRADE SERVICE

The upgrade service is provided for customers who wish to purchase upgrades for their existing computer that was purchased from us. We do not guarantee compatibility for systems other than the original order purchased and we assume that you have not installed any other components into the system when we perform an online check for compatibility. Please contact us by email with the part that you wish to upgrade and once we approve, you may ship the product to us. we assume that the computer is in a full working order and free from damage or defects. If the computer requires repairs and is outside of warranty these will be chargeable, and we will contact you to arrange payment before any upgrades are completed. Before paying for the upgrade service you will be given details of stock levels for each component you have selected. If the upgrade cannot be performed for any reason other than our own negligence you will not be entitled to an upgrade service.

 

SECTION 32 - USING OUR WEBSITE

The information, content and material available on the Website may vary from time to time without notice to you. This is in order to ensure that the Website is as up to date as possible. We always aim to have the Website available, however, you will appreciate that we cannot guarantee this or that it will be error free and we cannot accept liability for any issues that this may cause. We aim to keep the Website as up to date as possible; all product descriptions displayed on the Website are correct at the time the information is entered however the information appearing at the time may not always reflect the position exactly at the time you place your order. You must not interfere with the working of our Website nor must you circumvent security on the Website, tamper with, or hack into, or otherwise attempt to disrupt our computer system, server, Website, router or any other internet connected device or service. You must be 18 or older to use our Services. Minors under 18 and at least 13 years of age are only permitted to use our Services through an account owned by a parent or legal guardian with their appropriate permission and under their direct supervision.
